This Car Rental Agreement is entered into between Ayrton Paul Lohigorry, operating as Route 305 Rental Car / éPure Drive ("Owner/We/Us") and the Renter identified above ("You/Renter"). Both parties agree to the following terms:

1. Definitions

"Agreement" means all terms herein. "You/Your" means the Renter, any Authorized Driver, and any person billed at your direction. "Authorized Driver" means the Renter and any additional driver listed herein with a valid driver's license, at least 21 years of age. Only Authorized Drivers may operate the Vehicle. "Vehicle" means the automobile identified herein and all its tires, tools, accessories, equipment, keys and documents. "Physical Damage" means damage from collision or upset, excluding theft, vandalism, acts of nature, hail, flood, or fire.

2. Rental, Indemnity and Warranties

This is a contract for rental only. You may not sublease the Vehicle. We may repossess the Vehicle without notice if abandoned or used in violation of law or this Agreement. You agree to indemnify, defend, and hold us harmless from all claims, liability, costs, and attorney fees arising from this rental. We make no warranties, express or implied, regarding the Vehicle.

3. Condition and Return of Vehicle

You must return the Vehicle to the specified location on the due-in date and time, in the same condition received except for ordinary wear. Extensions require our prior written approval. You must maintain all fluid levels and return the Vehicle with at least the same fuel level. Service or replacement of parts during the rental requires our prior written approval.

4. Responsibility for Damage or Loss; Police Reporting

You are responsible for all damage to, loss of, or theft of the Vehicle during the Rental Period, including damage from collision, weather, terrain, and acts of God. Your responsibility includes: (a) repair costs or fair market value in case of total loss, less salvage; (b) loss of use at the daily rental rate for each day the Vehicle is unavailable; (c) an administrative fee: $0–$250 damage = $50; $251–$500 = $75; $501–$750 = $100; $751–$1,500 = $150; $1,501–$2,500 = $200; over $2,500 = $250; (d) storage, impound, and other incidental damages; (e) all enforcement and collection costs including attorney fees. You must report all accidents, theft, and vandalism to us and the police immediately upon discovery.

5. Insurance

You are responsible for damage or loss you cause to others. If you have your own valid USA renter's insurance, it will provide coverage. If not, you must pay the renter's insurance fee, or assume full liability for all damages, injuries, and third-party claims. If extra insurance is contracted, the deductible is $1,000 for vehicles valued under $35,000, and $2,500 for vehicles $35,000 or more. Coverage is void if this Agreement is breached or if you fail to cooperate in any loss investigation.

6. Prohibited Uses (voids coverage and terminates rental)

The following are prohibited: (a) operation by anyone not listed as an Authorized Driver, or by anyone with a suspended license; (b) operation under the influence of drugs or alcohol; (c) use for any illegal purpose; (d) use for hire, pushing, or towing; (e) use in any race, speed test, or contest; (f) teaching anyone to drive; (g) carrying hazardous or illegal materials; (h) use outside Florida without prior written approval; (i) driving on unpaved roads; (j) carrying more passengers than seat belts; (k) odometer tampering; (l) continued operation when fluid levels are dangerously low; (m) smoking or vaping any substance in the Vehicle. PROHIBITED USE AUTOMATICALLY TERMINATES THIS RENTAL AND VOIDS ALL COVERAGE.

7. Mileage

The rental includes the mileage allowance stated in the Reservation Summary. Miles driven beyond the stated allowance will be charged at the overage rate specified (default $0.25/mile), billed at return.

8. Payment and Charges

You permit us to hold a security deposit. You agree to pay all charges including: rental rate, optional services, fuel and refueling fees, government taxes, fees to locate or recover the Vehicle, attorney fees, a 2% per month late payment fee (or maximum permitted by law), a $50 fee for returned checks, reasonable cleaning fees for excessive mess or smoking evidence, towing and storage charges, key/transponder replacement fees, and a surcharge for returning the Vehicle to a different location or after the due-in date.

9. Tolls & Traffic Violations

You are liable for all tolls, parking citations, photo enforcement fees, fines for toll evasion, and other violations assessed during the rental period. You authorize us to pay any toll or violation on your behalf and charge you the face value plus applicable taxes and an administrative fee per occurrence.

10. Personal Property

We are not responsible for loss of or damage to personal property left in or on the Vehicle. Property left for more than 30 days may be disposed of at our discretion. You should wipe all personal data from the Vehicle's infotainment system before returning it.

11. GPS & Telematics

The Vehicle may be equipped with GPS, telematics systems, or event data recorders. You acknowledge and authorize remote monitoring, including collection of location, odometer, fuel level, and diagnostic data. We may disable the Vehicle upon breach of this Agreement. You agree to inform all drivers and passengers of this provision.

12. Modifications & Entire Agreement

No term may be waived or modified except by a writing signed by us. This Agreement constitutes the entire agreement between the Parties. All prior representations are void. Governing law: State of Florida. Venue: Miami-Dade or Broward County courts.

13. Miscellaneous

If any provision is deemed void or unenforceable, the remaining provisions remain valid. You release us from liability for consequential, special, or punitive damages to the extent permitted by law.
